Privacy Policy

1. Personal data controller

The controller of personal data processed within the Service is VESS Energy sp. z o.o., with its registered office in Gdynia, ul. Janki Bryla 23/32, Tax ID (NIP): 9581752461, REGON: 541163298.

This Privacy Policy defines the principles of processing and protecting personal data provided by users in connection with their use of VESS services through vess-app.energy and the reporting platform.

2. Personal data protection principles

To protect entrusted data, the Controller applies appropriate technical and organisational measures intended to protect personal data against access by unauthorised persons.

These measures are implemented in accordance with the Polish Personal Data Protection Act of May 10, 2018, the Act on Providing Services by Electronic Means of July 18, 2002, the GDPR, and other applicable legal acts.

3. Legal bases for processing

Personal data is processed on the basis of the user's consent under Article 6(1)(a) GDPR.

Data may also be processed where legal provisions authorise the Controller to process personal data, and for the performance of a contract concluded between the parties under Article 6(1)(b) GDPR.

4. Purposes of personal data processing

The Service processes data to provide services available through the Service, including newsletter subscriptions, responses to questions submitted through contact forms, and statistical analysis of site traffic.

Data is also processed to fulfil legal obligations imposed on the Controller.

5. Scope of processed data

The Service collects data voluntarily provided by the user, in particular through forms available on the Service.

This data may include email address, full name, and phone number if provided. The data is processed according to the purpose of a given form, for example to subscribe to a newsletter or receive a response to an enquiry.

6. Cookies and tracking technologies

The Service uses cookies to adapt content to user preferences and to conduct anonymous statistical analysis of site traffic.

7. Transfers to third parties

Personal data may be transferred to entities supporting the Controller, such as Zenbox Sp. z o.o. as hosting provider and MailerLite as newsletter delivery provider.

This data is not transferred or sold to third parties for marketing purposes.

8. User rights

Each user has the right to access their personal data, rectify inaccurate data, erase data, restrict processing, object to processing, transfer data to another controller, and withdraw consent to data processing at any time.

These rights are exercised subject to the rules arising from applicable law.

9. Changes to the Privacy Policy

The Controller reserves the right to make changes to this Privacy Policy resulting from the development of internet technology, changes in law, or the development of Service functionality.

Users will be informed about any changes in a visible and understandable manner.

10. Links to other websites

The Service may contain links to other websites.

The Controller is not responsible for the privacy policy applicable on those websites.

Platform Regulations

1. Service scope

VESS Reports is a business workspace for uploading consumption and technical inputs, running battery optimization scenarios, and reviewing generated report outputs.

The service is intended for professional users acting on behalf of their organisation.

2. Accounts and access

Users must provide accurate registration data, keep credentials confidential, and use only accounts and organisations they are authorised to access.

Access to the platform requires membership in an authorised domain or organisation. Individuals who are not affiliated with a registered organisation may not create or use accounts on the service.

Each organisation is responsible for assigning appropriate user roles and promptly removing access that is no longer needed.

3. Customer data and acceptable use

The customer remains responsible for the legality, quality, and accuracy of uploaded files, billing data, and operational assumptions.

Users may not upload unlawful content, attempt unauthorised access, interfere with the service, reverse engineer protected parts of the platform except where mandatory law allows it, or use the workspace to harm others.

4. Reports and decisions

Generated reports are analytical decision-support materials based on the data and assumptions supplied to the platform.

The customer remains responsible for verifying results and for all commercial, operational, technical, and compliance decisions taken on the basis of those results.

5. Billing and availability

Some workspaces or features may require subscription activation, plan approval, or acceptance of separate commercial terms before new runs can be created.

VESS may suspend or limit access where fees remain unpaid, security is at risk, applicable law requires action, or use materially breaches these regulations.

6. Changes, liability, and contact

VESS may update these rules to reflect product, security, or legal changes. The current version is effective from the publication date shown on this page.

To the maximum extent permitted by law, indirect or consequential losses are excluded, and VESS's total liability is limited to losses directly caused by wilful misconduct or the mandatory standard required by applicable law. Questions may be sent to info@vess-app.energy.
